These Terms and Conditions (“Terms”), together with all referenced documents, govern your use of the Rozitana (“Rozitana”, “we”, “us”, “our”) website and mobile applications (iOS and Android) (the “Platforms”) and apply when you place an order (“Order”) for any products (“Products”) through the Platforms.
By using the Platforms, creating an account, or placing an Order, you confirm that you have read, understood, and agreed to be legally bound by these Terms.
1. Changes to the Terms
Rozitana may amend these Terms from time to time without prior notice. Continued use of the Platforms following any update constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old to use the Platforms and place Orders.
3. Orders and Availability
All Orders are subject to availability and acceptance by Rozitana. We reserve the right to refuse or cancel any Order at our discretion, including where pricing, availability, or delivery information is incorrect.
4. Delivery
Delivery will be made to the address provided at checkout or to the address confirmed by the recipient once contacted. Rozitana is not responsible for delays, failed deliveries, or loss resulting from inaccurate, incomplete, or unconfirmed delivery details.
5. Circumstances Outside Our Control (Force Majeure)
We will not be liable or responsible for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control (“Circumstances Outside Our Control”).
These include, but are not limited to, acts of God, natural disasters, epidemics or pandemics, governmental actions, strikes, civil unrest, war, terrorist activity, fire, flood, failure of public infrastructure, telecommunications outages, or any lockdowns or restrictions imposed by governmental authorities in the Kingdom of Saudi Arabia.
If such circumstances occur:
We will notify you as soon as reasonably possible; and
Our obligations will be suspended for the duration of the event; or
You may cancel the affected Order, or we may cancel it on your behalf where performance is no longer possible.
6. Allergies and Product Warnings
Our Products, including but not limited to flowers, food items, beverages, cosmetics, and gift items, may contain pollen or other allergens.
Product descriptions may not identify all possible allergens. Customers with known allergies are advised to exercise caution. By placing an Order, you acknowledge that Products may cause allergic reactions, and Rozitana shall not be liable for any allergic reaction suffered by you or any third party (including household pets).
7. Limitation of Liability – Products
Subject to applicable consumer protection laws in the Kingdom of Saudi Arabia, Rozitana’s total liability in relation to any Product shall not exceed the total value paid for that Product.
Any damage, defect, or issue must be reported within 4 hours of delivery, supported by clear photographic evidence. We shall not be liable for loss of profit, business loss, business interruption, or loss of business opportunity.
8. Use of the Platforms
The Platforms are provided for personal and domestic use only. To the maximum extent permitted by Saudi law, Rozitana disclaims all warranties relating to the use of the Platforms, including accuracy, availability, or uninterrupted access.
We shall not be liable for any loss or damage arising from your use of the Platforms, including indirect or consequential losses. We do not guarantee that the Platforms will be error-free, secure, or free from harmful components.
Some services may rely on third-party providers (such as payment gateways or social media platforms, perfumes and other brands). We are not responsible for the acts or omissions of such third parties.
9. Governing Law
These Terms are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Saudi Arabia.
